Lok Adalat at Civil Courts Giridih Jharkhand

Lok Adalat was performed at Civil Courts with all zeal under the guidance of G.K.Singh the Principal District and Sessions Judge cum Chirman D.L.S.A. Giridih,after a long time president of Bar has been invited to witness in the adalat.Very encouraging step to indulge the bar in this National programme by the D.L.S.A.. i was in the bench no1 with Chandresh Kumar D.J. 1 IN THE BENCH AND feel the lok adalat requires more support from state.

Realisatation of cort stamps wrongly at civil courts chatra jharkhand

National/state and District legal services Authoritys claiming the implementation of legal aid programmer with fun&fare inviting top bosses,but what going on adjactly is matter of surprise.I HAVE OCCASION TO LOOK ONE CERTIFIED COPY ISSUED FROM THE OFFICE OF JUDGEINCHARGE civil courts chatra jharkhand wrongly stamped with a very higher rate contrary to civil courts rule prescribed in rule 408. I request the Principal District judge to get it examined by experts/stamp reporter of court and the thing rectified  for the beterment of litigants. I also request the bar to see the matter in right perspective and do the duty,because the bar is expected to perform the duty of ombudsman. God save the litigants.

Crime agaist labor cell

One poor daily wage earner Badri Yadav working since 1998 in the office of the District Probatition Gfficer Giridih Jharkhand removed from service by the Distrct Probatition Officer on his whilm ignoring all the exwcutive instrution/legislations and circulars by the Govt.Yadav represented before state Govt but nothing has been done by any body.Courts of law in the country is reeling with heavy backlog of cases but what yadav will do a poor man , the crime against labor cell is dead in the District of Giridih Jharkhand.God save Badri and others.I again reqest to top legal aid functionarys to to the distree of laborurs like Badri and save them.Otherwiswe no one will stop a public debate on the funtioning of legal aid programme in Nation.

The rule of law respects us as indivisuals.The rule of law is a fundamental component of democratic society and is defined brodly as the principle that all members of society - both citizens and rulers-are bound by a norm/set of clearly defind and universly accepted laws.The rights of citizens are determined by legal rules and not by the arbitrary  behaviour/action of authoritys.Legal profession has a vital role  to get it implemented.The profesion is a commitment to the people to protect their legal right.

The supreme court expressed its concern and anguish at the conditition prevailing in indian jails in the case of Snil Batra.Theapex court also observed in charls shobhraj case"Whenever fundamental rights are flouted or legislative protection ignored,to any prisnors prejudice ,the courts writ will run breaking stone wallsand iron bars,to right the wrong or restore the rule of law. One Ranjan K.Sinha Adv. and Social Activist of Giridih Jharkhnd informed thid blogger in the year 2011 a large no. of Under Trial Prisnors not been realeased on the day when RO recived by Jail but on the next day on the pretext'Number banke bad mila'. Who will see this?

The clinical establishment registration and regularisation act 2010

The Govt. of Jharkhand deptt. of Health and family welfare under his Notification No.62{7a] dated 08.02.2012 adopted the aforsaid act as per Govt of India Notification published in Gazzete of India extra ordinary part 02section 01 dated 19.08.2010 and directed all concerned to implement the same in true sense but the said act atleast not implemented in the District of Giridih.On rti it reveals only one formal meeting was held some time in may 2912 but non got registerd with the authoritys. Who implement this?

Good morning.Today we celeberate the day with fun and fare and think over issues of senior citizens.In my considerd view the state is required to pass legislation like Kerala .My good wishew  to senior citizens and all who worked for senior citizens.

Fate of senior citizens in judicial courts in the state of jharkhand.

The High Court of Jharkhand has been pleased to direct all the District Judges of State to dispose the cases relating to senior citizens prefferably within four months on day to day basis proceeding but nothing has been done in the state? Who implement this executive instruction the Bae,Bench,High court or Association of Senior citizens.On the eve of WORLD INFORMATION DAY I invite you to give your comment views on this matter.

Delay breeds corruption

On 16.07.2012 I sent RTI application to the P.I.O. O/O The Civil surgeon cum chief medical officer of Giridih Jharkhand.More than two month has been elapsed but he does not bother even to acknowledge the application.Sometime back Mrs Indira Gandhi rightly said DELAY BREEDS CORRUPTION. 1ST.Appeal has been sent to Secy.Depatt of Health Govt of Jharkhand with a request to ignite the nonstarter Administrators and direct them to furnish information without  any undue delay.

Role of court Manager in District Judicial Courts in Jharkhand

The High Court of Jharkhand has been pleased to appoint Court Managers in District Courts.We have one Manager at our Court at Giridih.May we know what he is doing whole day? The pathatic condition of premises spoke every thing,broken in sufficient furnitures tells the truth.Some time back Honble court directed the Judicial Admn.to place 24 chairs in every court for Adv,s is the said direction has been complied.No drinking water even for litigants or Lawyears available in court premises.

Honble Justice P.B.Gajendragadkar the then chairman Law Comission of India made some easy recomendations like the elimination of revisions to the High Courts.But the Parliamentarians in their innocense or guilt did not enact this.Is there a vested inetrest in litigative immortality? Functioning of Indian Oil Corporation inRTI

The Govt of India, Ministry of Petroleum and Natural gas has been pleased to direct all the oil companies under him to give some guidelines regarding the sale of raw petroleum coke from their oil refineries on 07.05.2012. The Ministry directed them to auction RPC with certain conditions on 07.05.2012 and expects the auction process shall be initiated within 60 days, that is on 07.07.2012. This Columnist has sent one RTI application to the Public Information Officer, IOC, Marketing division, Mumbai with a request to know they  mode of auction and other allied information but unfortunately no information has been furnished by this Maharatan Public Sector undertaking nor the RTI application has been acknowledged. On one side, everybody is advocating RTI and on the other side, this is the fate of RTI application in PSUs.

CJI's remark to adversly affect RTI drive:C.I.C.

Days after Chief Justice Of India S.H.Kapadia said that irrelevant RTI queries were impeding the working of Judges in courts ,Central Information Comission said the the remarks would have a significant negative impact on RTI. Information Comissioner Shailesh Gandhi ,in a letter to the CJI said that his coments could "dampen the RTI journey of India"

Gandhi admitted that RTI was being used in a trivial manner in a certain cases but he argued but it was also possible to show that progressive laws like dowrys act and atrocitys act were being used in in a "trivial manner or to harrass innocent people"

He added "it is also true that most public authoritys including information comissions and courts have not fulffiled the promise oh section 4 of the RTI actconsequent to which they are then complaining about increasing RTI requests" Courtsy TOI New Delhi 19.04.12

Labor Court Judge Atik Mohhamad Khan,52 was booked for alleged rape and atrocity in yawatmal on wednesday.Khan was booked when a women from pune lodged a complaint that he had raped her after promissing to marry her,the women a widow with two children-her husband died two yeard ago-alleged they were having an affair for the last ten years and were living together since Khan was transfferd to Gondiafive years ago.Khan is from Pune and has a family theare,S.P.RanjanKumar Sharma said- Courtsy,Indian Express New Delhi-19.01.12

Honble the Jharkhand High Court has been pleased to call for a detail report from all the Principal District&Sessions Judges ofjharkhand including the Judicial Commissioner of Ranchi to send the list of employees/Retd.employees/dead employees of Civil Courts whose service books is pending with Law deptt of state for verification by fax.This shows the concern of employer on apex level.Unfortunatly the service book of Vishwanath Singh an Retd. employee of Civil Courts Sahebganj will not come in this compartment,because his service book is running from Sahebganj Judgeship to diffrent Judgeships of restwhile state of Bihar and lastly the Judicial Administration of Sahebganj directed the retd.employee to get it verified by his own.Shamful and and unfotunate.

Lawyers hold key to end corruption in judiciary – Justice RM Lodha

In a clarion call to lawyers, Supreme Court Judge, Justice RM Lodha urged them to extend full co-operation in eradicating corruption from judiciary, because according to him 90 percent of corruption in judiciary is due to the lawyers' own conduct. The judge was speaking here recently at a function officially arranged by the Bombay High Court to celebrate 150th year of its establishment. Justice Lodha has been Judge at the Bombay High Court for 13 years, till 2007. In a function attended by Bombay High Court Chief Justice Mohit Shah, Kolkata High Court Chief Justice JN Patel, former Supreme Court Judge, Justice VS Sirpurkar, many sitting and retired judges of the High Court and members of the district judiciary here, Justice Lodha praised both the judiciary as well as members of the bar for progress of judicial system in the country. On this occasion, Justice Lodha unveiled portraits of Justice Hidayatullah, Justice JR Mudholkar and Justice AP Sen from the High Court here, who adorned the Supreme Court bench in the past with distinction. He also felicitated all the former members of the High Court Bar Association, who were High Court judges and retired since then.

The supreme court of india rightly srictured the central govt. on the point of promise annonced with fanfare the vision document promising to appoint 5,000 adhoc judges to wipe out pendency of cases among retd. judges and members from bar"Three years have gone by nothing has been done.We hope expect and trust from U.P.A.2 under the dynamic leadarship of Mrs.Sonia Gandhi she must do some thing as per promise given in presence of Chief Justice of India to the countrymen.We also hope the S.L.V. will be ignited as promised in the same venue under the chairmanship of Attorney Genral of India and others. The Retd. judges are resorvoirs and avilable in sufficianly in country to all level.This columnist also expect from supreme court of india collegium and Jharkhand High Court to fillup the vacacy of High Court subordinate courts. As per my information more than 300 posts of High Court Judges is vacant in country and a large no. of judges post vacant in jharkhand including Principal District Judges/Subordinate judges and Munsiffs.

Legal aid is not charity gift

If legal aid is entitelment of those eligible for it,rather than a charitiable gift,then,the mere attempt at assistance is not praiseworthy,in absence of consistent high quality of service leading to favourable results.This implies that legal aid cannot be left as a part time avocation of well-intensioned private persons or or judicial Administrators whose prncipal carrers lie outside the ambit of legal aid. The soul of the scheme is legal assistance,a specialised know how of the social technologists called lawyears to make shape to this national programme.The bar must lend its expertise librally to the poor who now look upon the law as an enemy,not as freind. Irequest the brethren to do something in this regard.

Success story of R.T.I.Act 2005 in Jharkhand

Finally the matter has been resolved by the state Govt.of jharkhand regarding fixation of pension and other retirel benefiets of late Rabindra Prasad Retd.Head Typisist of Civil Courts Giridih Jharkhand.The issue in qustion has been ignited by this columnist through R.T.I. in sevral forums viz.H.E.Governor of Jharkhand,Jharkhand high Court and Lokayukta of Jharkhand.I have no hesitation to say and write all concerned taken the same in right earnest.The Law Secy.Govt.of Jharkhand,and theJharkhand High Court under the Dynamic leadarship of Honble The Chief Justice Mr.PrakashTatiya done a lot for the widow of deceasad Employee.Lastly i have few words for the ministrial staff of law deptt. of the state lo look matters like this in right perspectiv and do not harass any body like this case,and its require dygnosis and pathology.I am also thankful to Sarvsri Sanjay Prasad the then D.J.of Giridih and present Principal Judge Family Court Ranchi who has been pleased to send the case again to Govt.after the case/finalisation matter was returned with refusal of promotion given to late employee. This is a victory of R.T.I.Act.
