Manzer Saheb former P p Giridih Passed today.He was a legal giant of Giridih BAR and champion for the causes of downtrodden and havenots.He always inspire us on various values of rule of law and always tell us  put your talent  and your resorces  to work and spread legal knoeledge and you surely be rewarded too.He also told us no dream is too big,no step is too small.I SALUTE Janab Manzer Saheb.

Implementation of Rule of Law

I am unable to understand how to proceed in law courts to implement the executive instrutions issued by our High Court.Nobody is redy to get it implemented.The Judiciary which is called repository of peoples faith,last hope,last ray is required to look in to it otherwise no one will stop the citiznery to make this a public debate.If this will not rectified the temple of justice may crack from inside.

Uncalled for advice to Newly appoited Ministers

Every public servant to consider that the public funds at his disposal are a sacred trus and more precious than his own money. I also have a piece of advise to new ministers and others who aspires to be minister,s in futire,please don't go about the job making advance declarations that you are going to teach lesson to all Government employees under you and that you are going to say them all their proper places.This posture is as fallacious as the work to rule agitation by your staff,because both these stances  are eqally conter-productive.Work to rule is really no work and showing them their proper place is really not the proper job for a Minister. The workers under you will only laugh behind your back and they will redicule if you have other weakness such as interfering with the transfers and posting of even lower grade staff.. Your own personal staff also must know that you are a man of principles and tolerate no nonsense. your impartiality is the best shield for you and this must not be negotiable.

Fate of Senior Citizen in subordinate courts of Jharkhand

The high court of Jharkhand has been pleased to direct all the Principal District and Session Judges of State including the Judicial Commissioner of Ranchi to direct all the subordinate judicial officers to dispose of cases relating to senior citizens pending in their courts. With utmost care, in sensitivity  there is a clear direction from Hon'ble Court to dispose of cases of above category within four months and dates were adjourned preferably day to day. In the light of instruction issued from hon'ble court, copy of letter has been submitted before one judicial magistrate, 1st Class at Giridih Jharkhand, to pass necessary order in a 20 year  old case relating to a senior citizen since four months back but unfortunately nothing has been done. The prosecution is not taking any interest to produce witnesses in judicial court, even the prosecutor is not appearing for state. The matter has been reported to the SP Giridih, for production of witnesses, even then no progress as yet. The district level monitoring committee has been upraised by the presiding magistrate as he told this to defense counsel. Some time back in the year 2009 at vigyan bhawan New Delhi regarding the pend ency in judicial courts, it was observed in presence of PM of India, Chief Justice of India and Union Law Minister of India. "State is the biggest litigant". I hope expect and trust, every one who is connected with the judicial system, whether he is a judge, prosecutor, lawyer, judicially staff and others, try to establish rule of law otherwise time will come when people will debate the functioning of Judicial Courts [subordinate courts] in the country or at least in the state of Jharkhand.

Lok Adalat or Joke Adalat

Unfortunate and shamful one Civil Judge Junior Division at Giridih Jharkhand declined to send the file in Lok ADALAT ON THE plea that accused is not surrenderd in his court and the the compermise papers not been signed by the then official complainantwho has been retired some time back in a compoundable case.The brief fact is that comlaint was filled by the Branch Manager of a Nationalised Bank in official capacity and compermised bvy his successor in office. God save the lehaql aid programme with such Judges.

Judicial Employee suspended for failing to make Fish Curry for Judge

Sometime back, I have gone through a judgement by our supreme court in which Hon'ble court has been pleased to observe "Judiciary is the repository of people's faith, last hope, last ray". The court further been pleased to observe the temple of justice may not crack from inside. Few days back, I have gone through a page clipping, published in Times of India, New Delhi edition, dated January 4th, 2013 under caption "Court Staffer suspended for failing to make fish curry?" Unfortunate and shameful on the part of a judge. It is also unfortunate, when the matter has been ignited by a public spirited lawyer before the High Court of Madras, the court has been pleased to dismiss the petition at the stage of admission itself, and pointed out that the affected employee had not chosen to bring the matter to the court.

This is the state of affairs in the subordinate judiciary of Tamil Nadu.

I hope, expect and trust, Hon'ble the chief justice, Madras high court will kindly look into the matter in the right perspective and direct the unbridled judges to behave like public servants and like a judge.

Views/comments solicited so that misery of poor employee may be discussed and such ugly scene may not occur with others. I remember, Dr. Justice RK Laxmanan, formal judge, Supreme court of India, who wrote regarding behavioral approach of judges towards their subordinate employees in his book "Voice of Justice".

JHALSA Active efforts in the matter of Nyaya Sadan in the State of Jharkhand

Nyaya Sadan, The brain child of Dr. AS Anand, Firmer Chief Justice of India and Patron-in-chief NALSA, is expected to be implemented come on earth in te state of Jharkhand under the able commendable and clear vision of Hon'ble The Chief Justice, Jharkhand High Court cum Patron-in-chief of Jharkhand State Legal Services Authority, Mr. Prakash Tatiya, Judge, Jharkhand High Court and Executive Chairman, Mr. Justice DN Patel with the active participation of Mr. BK Goswami, member secretary and Mr. Satya Prakash, Deputy Secretary of the Authority.

So far, district of Giridih is concerned, as a legal aid worker, I want to suggest the state authority, please select the site of Nyaya Sadan, in the old jail, already vacated by Jail Department, near Civil Courts and Office of the Deputy Commissioner or the premises occupied by the DSP's in front of DC Office is very much proper for Nyaya Sadan.

Nyaya Sadan is a central secretariat for legal aid programs and a very important office so, it requires proper selection of place. So that people in distress may contact the authorities without any hindrance and obstructions.

I hope, expect and trust, we the legal aid workers, assist and co-operate with all zeal and flavor to this program of National significance.

Functioning of suborinate judicial courts in jharkhand.

I am quoting few lines of order passed by Jharkhand High Court while hearinig A.B.P.No.840/2003 on 26.08.2003"It being detected that regular bails are rejected unmerited rejection of regular bails is as bad as bad as unmertted grants of such bails".The increasing number of Anticipatory bail applications is unnecessary burdning the High Court,if this plea of Advocates that even in meritted cases regular bails are not being granted by the lower courts is correct,then it requires dygnosis and treatment it is not good for thar reasons,the poor litigants should not move the High Court of the state on heavy cost. The Court further observed "This is very peculiar state of affair when the learned courts below are not discharging legal duties accrding to law consiquently,there is a great rush to High Court,even though in such cases,in ordinary course,the bail should be granted by the lower courts."The is to see that all the courts state do the funtion and funtion with responsibility and accrding to law.The lower courts should realize this legal situation,lest they invite certain displeasure oh this court" The bench further been pleasad to direct the registry to place ordre before Hon'ble the chief justice for information regarding the funtioning of subordinate courts in the state.This order was circulated by the Registry to the lower courts but nothing has been changed.Who will get it implemented?

Condolence on the sad demise of Damini victim of Gangrape at New Delhi at District Bar Association Giridih Jharkhand

We the members of Distt.Bar Assn.Giridih jharkhand hol a condolence Meeting in the Bar premises to condole the sad demise of Damini the ill fated girl victim of gangrape at Delhi.I have no hesitation to say,Kanchan our Secratry Genral trying hard to restore the prestige and honour of members and get them involved in the burning issues of society.Some time back Honble Mr. Justice V.R.Krishna Aiyyar Former Judge Supreme Court of India says"The lawyears have not only coomercial transaction with litigants but they are social engineers and see the problem faced by society". New Year 2013

Happy New Year 2013 to all my esteemed viewres. I again remind my brothren to work like sewak in legal profession.The then CJI of supreme court of india while delivering speech at the 150th aniversary of Govt.law college mumbai at Y.B.Chavan auditorium requested the bar members to work like sewak of society. Today we take a pledge to do some thing for society,because this is a matter of concern  to see how poor litigants stand in this justice market.
