It is very strange that even after knowing that the petitioner is not in custody under any lawful order yet the respondent delibratly did not release the petitioner from the custody even the accused has right of liberty till he is taken in custody by any lawful order.This not a obiter rathar this is a Judgement deliverd by non else but by the Chief Justice of Jharkhand High Court in the matter of one Amit Singh on 21.10.2011 in W.P.Cri No.156/2011.The Jail Supdt. of BirsaMundaCentrel Jail Hotwar fairly admitted on a RTI querry by this columanist that UTPs detained on the strenghth of Production Warrant in Centrel Jail of Ranchi.Some time back Supreme Court observed"Something rotten in denmark as shakerpear said in hamlet similerly some thing rotten in Allahabad HIGH Court" But i am to say some thing rotten in home deptt of Jharkhand who is incharge of jharkhand jails. Rule of law in jharkhand

The rule of law is fundamental to all democratic order.Rule of law means no indivisual whoever he may be stands above the law.Democratic govts. exercise authority by way of law and are themselves subject to law,s constraints.The rule of law respcts us as equals.Legal profession has a vital role to play in the Administrtion of justice ,not merely on representing one of parties to the litigation but as officers of court.The profession is a commitment to the citiznery to protect their legal and fundamental rights,but i am feeling the true purpose is on back burner to overtake the goal.The rights of indivisuals are determind by established legal rules and not the Arbitrarary behaviour of authoritys. I hope expect and trust my brethren to think over this burning issue in bar.

Implementation of High Court Rules and Court fee Act in Jharkhand Courts

God save jharkhand.In this state Rule framed by High Court and Court fee act enacted by legistlature is not followed,even the champions of Bar has no grudge to ignite the Administration on this burning issue of public intrest.I have tried my level best to get the things correct but unfortunately no one is ready to get the things corrected. Wrong realisation of stamps in the copying section of suboridante courts isnot looked in to by the persons who were expected to see all this including judicial officers,Advocates, law secy of state and others.

Former Judge of Jharkhand High Court seeks justice

Pension is not a bounty rather a valuble right vested with a govt. servent as per apex court,but in the state of jharkhand a retd.constitutional authority C.I.C. of jharkhand Mr.Justice HariShanker Prasad moved the state judicature for his pension served as C.I.C. of state. Prasad running from dead pillar to dead post in govt of jharkhand finally filled a writ before High Court of jharkhand for justice and the High Court in the month of jan,2011 directed the state govt to pass a reasoned order,but state had refused the claim on the sole ground the finance deptt. not concurred.The parent state of Bihar paying pension to retd.C.I.C. who is a retd.H.C.Judge.Again a petition has been presented before High Court and the High Court Show Caused the O.P.S Union of india,A.G.of jharkhand and Chief Secy.Finance Secy. of jharkhand with Secy to State Information Comission of Jharkhand. This shows how much state is intrested to solve the disput out of court and through A.D.R. Views opnion solicited to curb the unnecessary litigation due tostate on state cost.

Lastly Kiran sent a affidavited petition duly stamped to the Highest watch dog of state the Lokayukta of Jharkhand but unfortunatly after a lapse of more than two months Kiran is not been able to get justice. Some time back supreme Court observed"Judiciary is repository of peoples faith last hope last ray.The office of Lokaukta is headed by a Retd. Judge of High Court Can Kiran get justice soon.

The state and financial institutions are required to come forward in right earnest and clean hand to get the things resolved in a rightful way.It is also expected from BAR to assist the judiciary and state to get the Mega Lok Adalat a grand success.

Role of women Advocates

Judiciary has a very vital role to play and protecting /preserving human rights/fundamental rights.And this role of judiciary can be effectivly fulfilled only with the coopration and honest effort of the entire lawyearing community.The judiciary should give women Advocates a vital role to play in the legal system thereby encouraging women Advocates to approch the courts for the protection of rights of many needy and underprivileged sections of the society especially the women,children and senior citizens.

Non implementation of S.C.Order by private Hospitals at New Delhi

Jut now at about 12noon,I along with my son in law Kunal Mayank went to Max Super Speciality Hospital Saket New Delhi and enquired about the implementation of S.C.Order regarding poor patients in O.P..D. and indoor in the said Hospital but the receptionist is unaware about the decisions and in our presence he telephoned one Mr Shaan working in the Administrative department and Replied that such facilities is not available in Max Saket hospital,certainly he told us in other buildings of Hospital this facilities is going on.

I have firm belief that private Hospitals of Delhi is Floating Supreme Courts order,hence it is Expected from all concerned to get it implemented at any cost,otherwise a wrong signal/message will go.I request Hon'ble The Cheif Minister of NCT New Delhi to look into the matter personally.

Crime against labor cell.

The Supreme Court of India rightly held in a case on 02.o9.2011,time to end crooked labor practices.This is common practice today in industry to say that this man is not my employee he is a man of contractor only to shirk from the responsibility to implement the various labor laws and legislation enacted by state.Its high time this subterfuge comes to an end said a bench of Justice M.Katju and Justice C..M.K.Prasad while delivering the verdict.it has been observed by their Lordships Laws were meant to protect workers/Employees/workmen from exploitation as they were not on an equal bargaining position. Earlier requested several times to NALSA to ignite the crime against the labour cell in every sessions divisions of Country under the chairmanship of District and session Judges the scheme is a brain child of Hon'ble Mr Justice Y.K Sabharwal the then chief Justice of India cum Patron in chief of NALSA for the poor Labourers of Country.I again request the same with inclusion to observers from NALSA .I request the social Activist to impress upon all concerned to implement Labour Laws without any further delay.

RTI activist assaulted in Gujrat

An RTI activist in Jetpur in Gujrat Rajkot District was allegedly attack by Jetpur Nagarpalika President and husband of a women councellor for seeking details on alleged illegal apartments that have recntly come up in Jetpur.

They assailants have been identified as Suresh Sakhrelia and Rakesh Gol,Husband of Councellor Kanchan.Ajay Ambalia 40 wo is being treated in hospital lodged a police complaint but no action has been taken by Police till now.I Dhirendra Prasad request the Dynamic,Diamond hard Cheief justice of Gujrat high Court to look into the misery of RTI Applicant/Activist in the intrest of justice. Role of R.T.I.Act in Democracy

In the state of Jharkhand a debate has been ignited by Vastva india trust on RTI Act and role of the said act in democracy.They organised a seminar at chaibasa the Divisinal H.Q. of Kolhan Division of Jharkhand.I have been ocassion to atetnd the seminar as a speaker and found they Kolhan people very much opressed and depressed and they were deserve proper guidance in the matter of using RTI Act. I request the NALSA and JHALSA to include RTI,RTE Acts in legal litrcy programmes for the upliftment of weaker section of mass.

Requirement of Natural Justice

Natural and fair Justice is no unruly horse, no lurking land mine, nor a judicial cure-all. If fairness is shown by the decision maker, authorities to the man proceeded against/to the man who is expecting a constitutional or any appointment in the state, the form, features and the fundamentals of such essential processual propriety being conditioned by the fact and circumstances, merit of each case, no branch of natural justice can be complained of Unnatural expansion of natural justice, without reference to the administrative realities and other factors of a given case can be exasperating.

If the totality of the circumstances, satisfy the decision maker, it is expected he will pass administrative order as per norms settled by law.

To day we have gone trough a news item in times of india New Delhi "72 Year old R.T.I.activist stabbed in porbandar".This is alarming.R.T.I.Activist Bhagu Devani named ex B.J.P.Minister Babu Bokhiria as suspect.This is a matter of investigation but it is expected the incident,criminal act must be investigated and the real culprits may be booked without any delay,so that everybody work in a free and rightful manner.Some time back Activist Ameet Jethwa was killed in front of High Court of Gujrat.One Municipal Chairman alsonamed F.I.R. accused, it requires stern action by law implementing authoritys and top police personel. How this golden law will be implemented in the land of Lauh Purush Sardar Saheb.

Yesterday on 25.06.11 His lordship Honble Mr.Justice B.S.Chauhan Judge supreme Court of India visited Mahasamadhi sthal of lord langeshawari Baba along with his wife and Acting Chief Justice of Jharkhand High Court Mr.Justice Prakash Tantiya and his wife and pay respect to Baba.On this ocassion Honble Justices of Jharkhand High Court Sarvsri N.N.Tiwari,R.R.Prasad,Prashant Kumar also present.The C.E.O. of Jharkhand High Court Mr.P.R.Dash Registrar Genral welcomed the guests alongwith District Judge Mr.P.K.Srivatva,Deputy Comissioner Mrs.V.Dadel,A.D.J.Mr I.D.Mishra,C.J.M.Mr.R.N.Mishra,S.D.J.M.MissR.Asthana,Judge in_charge of civil courts Mr.N.Vishwakarma.Mr.J.P.Sinha D.F.O.Giridih and Mr.Sachidanand Singh of civil courts also witness the ocassion. It was expected members of Bar to be present on Kharagdiha to welcome the legal lumineris in the District.Alright we may corect this on next time.

Cashless Medical Facility to maids .

This is a very good and fine decision of central Govt. Now a poor person working as maid will be treated in private hospital/nursing home on showing smart card.It requires canvasing through Zila Parishad/Panchayat Samitis/Legal Services Authoritys in village and taluk level. I request the NALSA/State Govts./N.G.O,S to get it propogate and implemented in real sence for the benifiet of poor maids. I also request the young lawyear brothers and sisters to carry this flag of legal awareness in society.

Conviction in chilkari trial at Giridih Jharkhand

The 1st.Adll.Sessons Judge of Giridih Jharkhand deliverd judgment in the sensational trial of chilkari mass carnage, Mr.Babulal Marandi former C.M. of jharkhand who lost his beloved son Anup in this carnage comented very fairly on verdict and says punishment is to harsh,and also requested to talk with rebels and get them in main stream of life. Ex-CJI didn;t disclose assets information for 2007_08

The home ministry Govt.of india has asked the finance ministry to conduct a probe in to the assets of former C.J.I. and present chairman of N.H.R.C. Honble Mr.Justice K.G.Balakrishnan. If the allegations are found to be true home ministry will go the president seeking sanction to prosecute him and also remove him from the chairmanship of N.H.R.C. In the indian judicature perhaps this is a lone case by which former C.J.I.is investigated in such a way and manner. Legal giants sugested Mr.K.G.Balakrishnan to resign from N.H.R.C.but he refused to do so,even he come to the press with a word he will use his dalit card. God save the prestige and credibility of institution.

Legal Litracy Mission of India

I have tried my level best to trace the said mission and achievment of said mission but couldnt find the same any where,i find only the logo of said mission on the stationery of NALSA,JHALSA and D.L.S.Authoritys. I surfed the internate,sent letters to all concerned with the said mission,after runing from dead pillarto dead post i left the search opration on my younger genration of lawyears/researchers and others who may trace out the same mission and may know the achievment of the mission for the poor countrymen of our beloved country MERA BHARAT MAHAN.

Implementation of Rule of law in suboridanat judiciary

Today we have a discussion with Mr.S.P.Buxi our former president of Districrt Bar Associatation Giridih Jharkhand to ignite the system with Admn. of justice to implement the rule of law. During the course of meeting as per Buxi His Lordship Honble Mr.JusticeD.N.Patel Judge Jharkhand High Court and Zonel Judge of Giridih sessions Division assured he will look in to implementation of rule of law atleast in the session Division of Giridih similerstep is expected from Jharkhand State Legal Services Authority.

No work for judges in jharkhand.

From 01.04.11 a large number of judicial officers of the rank of Adhoc A.D.Js. sat ideal in the corridor of Jharkhand High Court with no judicial or admn. work by the order of jharkhand High Court for no fault on the part of officers. The court of law is reeling with heavy backlog of dockets and the state is not taking any intrest in the matter, it is expected from Honble High Court and Govt. of Jharkhand to get the judges deployed some where and use this human resorvoir in the intrest of justice and save the state exchequer.

Yesterday on 09.06.11 i have pressed/moved bail petition of accused/susprct pradeep paswan before a civil judge junior division in a judicial court at Giridih jharkhand in a criminal case bearing jamua P.S.case no.59/10 ,the Presiding Officer tld/requested me not to press the bail petition today as he is not in a position to dictate the order today hence he desires the matter be pressed on monday on 13.06.11.This is the state of affairs in the lower courts,the Presiding Officer Mr.C.Ram is the Secy. of D.L.S.A. also how sensitive he is with Under trial prisoners {petitioner Pradeep is a U.T.P.]. I am recording all this for my own satisfaction and circulation to all concerned with the system.

God save Vinoba Bhave Univercity Jharkhand

Since 36 hours i am trying to contact the Vice Chancellor,Registrar of the said varcity for urgent work,strange and unfortunate they do not even pickup the cell.The Law college at Koderma realising money illegally from law students and no one is ready to hear the illegal acts of authoritys.The future power of indian judiciary reported the high handedness of law college to me and as a law abiding person i have tried to contact the V.C and others but could not succeed. I hpe expect and trust the future power of judiciary wii never pay bribe to college and raise the issue before H.E.Chancellor of the Varcity and not compermise with this.

U.N.MAY DOWNGRADE OUR N,H.R.C.

The U.N. may downgrade Human Rights Comission O f India.It is reported in press that,theNHRC already demoted from the status of participent to observer.Among other allegation agaist the NHRC headed by Honble Mr.Justice K.G.Balakrishnan former chief justice of india.It has been alleged to the acridatio body,the failure of NHRC to protest the incarceration of internationally reputed human rghts activist/crusader of downtrodden Dr.Binayak Sen in a concocted sedition case launched by state of chhatisgarh.N.H.R.C. silence is srange.The allegation of graft against its chairman is also levelled. I humbly request Honble JusticesV.R.Krishna Aiyyar and J.S.Varma pl. do something to save the prestige of NHRC and country. Some one may use his Dalit card or any card whatever may be,the country is last sanctuary for all.

I have submitted one RTI apliction to the CPIO of Jharkhand High Court and wats to know ,whether Govt.of Jharkhandsend any letterregarding the closure of Fast Track Courts in the state if reply is affirmative i request them to furnish the copyof letter if any.I hope,expect and trust our Honble Chief Justice will look in to it in right perspective and implement the effectivness of golden law.

Dr. Binayak Sen.a veteran Human Rights Activist has been inducted in the planning commission of India for his valuable suggestions in the health sector.Indeed it's a very good selection,a real social worker is working in the most interior of Chattisgarh and aquainted with miseries and sorrows of aam aadmi particularly the poor shceduled tribes in the dense forest of Chattisgarh where no basic needs is available for them.Unfortunately the Govt. of Chattisgarh opposing his induction in the plan panel teeth to nail even the chief minister of chattisgarh Dr. Raman Singh wrote to PM,they will boycott planning commission's meeting till Binayak's removal from planning commission.Is it proper from the executive head of state?Is it judicious on the part of chief minister of a state.What is the fault of Binayak,he has been convicted by a additional sessions judge at Raipur sessions division within the state of Chattisgarh in a case of no evidence at least against this poor social worker.While hearing the case,the apex court (Supreme Court of India) observed weak evidence,also said if someone keeps the photograph of gandhiji whether he has been declared Gandhian and granted bail to Dr. Binayak Sen.In such circumstances they approach of Chattisgarh CM is highly unjudicious and requires diagnosis and pathology by CJAR.

Summons to Justice Nirmal Yadav

NirmalYadav former judge of punjab and haryana,uttrakhand high court moved punjab high court with a prayer to quash summon issued by the court of C.B.I.Judge Chandigarh, bench headed by Honble Mr. justice Pramod Kohli of punjab and haryana high court dismissed her petition and directed her to appear before lower court, it is expected as setteled principle of law the order of Honble court must be communicated to the lower court, means the accused and the lower court both know what to do in such circumstance.Needless to write anything more.

First of all i welcome the Honble ChiefJustice of our Honble High Court of Jharkhand.Govt.of india has been pleasd to direct all his ministrys and directorates to put the logo of R.T.I. on the stationery used by them,similerly i request the honble court to impress uopn all the District Judges of jharkhand including the judicial commissioner of Ranchi to use the logo of R.T.I. on stationery used by them and offices working under them.I have no hesitation to say again the judiciary is unfreindly with R.T.I. and this positive assertion will give a ray of hope, in the implementation of golden l aw in judiciary.with highest regard,s. Ihope,expect and trust the honble court will look in to it in right perspective.

Times of india NewDelhi published news caption under above heading,its a matter of great pleasure and encouragmet for R.T.I. crusaders and indivisuals who were intrested in the flourishment of golden law.I Dhirendra Prasad Congrat for this forsightness to all the functionery of Govt. those concerned in taking such a grand decision.But i feel it incumbent on my part to caution that some time back NATIONAL LEGAL SERVICES AUTHORITY OF INDIAimpressed uponALL THE STATE LEGAL SERVICES AUTHORITYS across the country to put the logo of NATIONEL LEGAL LITRACY MISSION on the stationery of state authoritys and Distict legal services authoritys working under them,logo has been placed every where just as on letterheads,envelops but work of national legal litracy mission is not visible any where atleast in the state of jharkhand,so this may not happen with the goldenlaw.

I have seen a report in news paper Justice Nirmal Yadav a former judge ofHigh Court of Uttrakhand has been summoned by a court of judicial Magistrate of chandigarh to answer a charge of corrupton.Mrs.Yadav was earliar judge of Punjab and Haryana high court. The legal profession is a solemn and serious occupation .It is a noble calling and all those belong to it are its Honble Members.Although the the entry to the profession can be had by acquiring merely the qualification of technical competence,the honour as a professional has to be maintained by its members by their exemplary conduct both in a outside the court.The legal profession is diffrent from other professions in that what the laeyears do,affect not only the indivisual but the Admn.of justice which is the foundation oh civilised society.The society has a right to expect of him such ideal behaviour.

I am writing this post for my young lawyear brothers, the image of lawyears would depend entirely on the role which they play in solving the national ind other problems facing the country ,if the lawyears stand up to the task facing yhe country ,they would be realy playing the role destined by them.Good wishes.

Iam unable to under stand who come to see the misery of undertrial prisnors in suboridynate courts.Just now i have a very sad experience with the escort party members of a police party from Birni P.S.within the Distt. of Giridih Jharkhand when Under Trial Prisnor Mustkim denied his signature to be attested on vakalatnama by the escort party.How he will present his bail applicat.ion before court.I hope,expect and trust the top police personnel will look in to the sad plight of UTP,S.Mustkim has been forwarded by Birni Police in Birni P.S. Case n0.146/10

Success of RTI in jHARKHAND

I have occasion to ask sum question to the PIO o/o/the DSE Giridih jharkhand.The PIO is so reckless even he does not bother to acknowledge the petition.THE ENTIRE EPISODE HAS been reported to the 1ST.appelate authority,information comission of state and the secy dept. of HRD GOVT OF JHARKHAND but no action from any quarter.The information seeker runing from dead pillar to dead post but no body is responding.Ultimately I slapped a notice to PIO for legal action then information has been furnished.This is a success story of RTI.
